Terms of Use

1. Agreement

These terms are an agreement between you and Visai Yazılım Ltd. Şti. ("we", "us") for the ProDuckTivity mobile app and the website producktivity.net (together, the "Service"). By downloading or using the Service you accept these terms and our Privacy Policy. If you do not agree, do not use the Service.

If you got the app from the Apple App Store, Apple's Licensed Application End User License Agreement also applies. Where it conflicts with these terms, these terms apply to the extent Apple allows.

2. The app

ProDuckTivity is a focus timer. During a session it uses your phone's camera, and optionally its microphone, to guess whether you are paying attention, and reacts with a deliberately rude cartoon duck. Detection is automatic and can be wrong: it may miss distractions or flag you when you were focused. Focus scores are for fun and motivation only.

The app's humor is intentionally harsh. If you would rather not be yelled at, you can lower the strictness or turn the sound off.

3. Free plan and Pro

• Free: one focus session of up to 25 minutes per day, with the default timer settings. In-session controls stay free.
• Pro: unlimited sessions and the full Settings screen (timer length, strictness and sound modes).

We may change what each plan includes. If we remove a Pro feature you paid for, we will tell you in the app before your next renewal.

4. Subscriptions and billing

• Pro costs $4.99 per month or $39.99 per year in the US. Prices in other countries are set by the store in your local currency and may include tax.
• There is no free trial. Payment is charged to your Google Play or Apple ID account when you confirm the purchase.
• Your subscription renews automatically for the same period and price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• You can manage or cancel your subscription in your store account: on Android, Google Play > Payments & subscriptions > Subscriptions; on iPhone, Settings > your name > Subscriptions. The app's Settings screen also links there. Deleting the app does not cancel your subscription.
• When you cancel, Pro stays active until the end of the period you already paid for.
• If we change the price, the store will notify you in advance as its rules require, and you can cancel before the new price applies.

5. Refunds

Payments are processed by Google or Apple, so refunds follow their policies. Request a refund from Google Play or Apple. We cannot issue refunds ourselves. This does not affect any rights you have under consumer law where you live.

6. Using the Service

We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control. You agree not to:

• copy, modify, reverse engineer or resell the app, except where the law allows it;
• get around the free plan's limits or the subscription checks;
• use the Service to break the law or to film other people without their consent;
• abuse the website or the waitlist, for example by submitting other people's email addresses or flooding it with requests.

7. Health and safety

ProDuckTivity is not a medical device and does not diagnose or treat anything, including attention conditions. Take regular breaks, and do not use the app while driving or doing anything that needs your full attention elsewhere. Keep the phone somewhere stable while it watches you.

8. Our content

The app, DuckHead, the artwork, voice lines, sounds and text are owned by us or our licensors and protected by intellectual property laws. You may share report cards and screenshots of the app for personal, non-commercial purposes.

9. No warranty

The Service is provided "as is" and "as available". To the extent the law allows, we make no warranties of any kind, including that it will be error-free, always available or accurate at detecting focus.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost data, profits or productivity. Our total liability for any claim about the Service is limited to the amount you paid us for Pro in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

11. Ending use

You can stop using the Service at any time by uninstalling the app and cancelling any subscription. We may suspend or end your access if you break these terms. We may also stop offering the Service. If we do, we will try to give you notice, and you can ask the store for a refund of any unused subscription period under its policies.

12. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell you in the app. Continuing to use the Service after a change means you accept the new terms.

13. Governing law

These terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules, and the courts of Kocaeli, Türkiye have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and can bring claims in the courts where you live.
